This Terms of Use Agreement establishes the standards of use of the RentMe-AZ.com’s Online Service for Registered Members. By using the RentMe-AZ.com website you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at RentMe-AZ.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgment and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended. This is a legal agreement between you and RentMe Corp. ("RentMe-AZ.com") for the use of RentMe-AZ.com's and other websites.

RentMe-AZ.com maintains a website to provide an avenue through which property owners/managers (“Lessors”) may place information about their properties and goods in front of potential tenants (“Renters”).

Our website does include links and we post content to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therein. We encourage all Members to review said privacy policies of third-parties’ sites.

There is no rental listing fee. This is a free site, available to anyone for the furtherance and assistance in promoting real estate for the support of a better economy, nationwide.

This is a free service and is for registering, and posting of an ad to feature a rental property and for communicating with perspective renters. It does not matter, (a) whether the Renter enters into a lease transaction after receiving your property information through the listing feature, (b) whether the Renter accepts an offer of housing seen thru RentMe-AZ.com’s behalf or (c) whether the Renter accepts an offer of housing presented to the Renter outside of the website, the site is free. Your rental ad listing is solely for the purpose of describing the particular rental property’s for rent and may not contain any links to other websites nor reference to such links. All listings must be for properties that are actually available for rent. Failure to comply will result in a warning or possibly deletion of your rental ad without notification or refund.

Each rental listing advertisement must be for one property address, or unit in an apartment community. Listings directing visitors to other properties, or advertising multiple available properties are strictly prohibited. Failure to comply will result in an additional posting charge, a warning or possibly deletion of your rental ad without notification or refund.

Each rental listing advertisement must include an active and legitimate telephone number so that renters and or we can reach you, your agent or property manager.
If you choose to have replies sent to you via email, RentMe-AZ.com is not responsible for replies that are not deliverable because of an incorrectly entered email address or any other error that involves the destination email address or the destination email server.

Rental ad listings are valid for 30 days from the day of posting and can be taken down ("un-posted") prior to the expiration date but will not receive any refund or partial refunds. Billing can be canceled no less than two days prior to the billing date.

RentMe-AZ.com provides all users with the opportunity to correct, update or delete information stored in their account. To review, modify or delete your account information, simply log into your 'My RentMe-AZ.com Home' page and select the 'Update Your Profile' link

You will receive a password and member account designation upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify RentMe-AZ of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Rent Me-AZ.com can not and will not be liable for any loss or damage arising from your failure to comply with this Section.

RentMe-AZ.com reserves the right to change the content of any ad for reasons such as breaking the terms and agreement, improper spelling, profanity, referencing other websites, or any other reason it deems necessary to change. You are not permitted to use HTML coding in RentMe-AZ.com ads.

RentMe-AZ.com complies with state and federal civil rights laws, including the Fair Housing Act and the Americans with Disabilities Act. You agree to comply with such laws and agree to avoid stating any preference based on race, color, national origin, religion, handicap or any other category. At other locations in this website, RentMe-AZ.com may remind you not to include information that is potentially actionable under such laws. In that RentMe-AZ.com serves as a conduit for information on the basis of which you could unlawfully discriminate against potential Renters, you hereby agree to defend and indemnify RentMe-AZ.com, it’s owners and partners.

In using RentMe-AZ.com's website, you acknowledge and agree as follows: (a) RentMe-AZ.com does not participate in any actual lease transactions, including, without limitation, negotiations, discussions or proposals; (b) RentMe-AZ.com does not render legal, brokerage or other professional advice or services; (c) RentMe-AZ.com is not undertaking any, and has no fiduciary duties to either Renters or Lessors, including, without limitation, the obligation to inspect rental properties or to verify the veracity of information contained in a preview of your property or offers; (d) RentMe-AZ.com is not responsible for the content of, nor does it endorse, the third-party websites to which you may link using this website; (e) RentMe-AZ.com does not guarantee the accuracy of any information available on or thru this website, and is not responsible for any errors, omissions, or misrepresentations, whether made by landlords, renters or otherwise and all information obtained on this website or from any landlords or renters must be verified independently; (f) RentMe-AZ.com may make changes to its products and/or services and this website at any time and without notifying you or receiving your consent; and (g) while RentMe-AZ.com complies with state and federal civil rights laws, RentMe-AZ.com assumes no liability for others failures to comply with such laws.

By registering your property's information, you consent to RentMe-AZ.com placing and sending information about your registered property on RentMe-AZ.com’s website, and any and all other websites before the public, subject to RentMe-AZ.com’s Privacy Policy. You agree that RentMe-AZ.com’s website shall be used only to legitimately preview your properties and make legitimate offers in accordance with RentMe-AZ.com's  rules, policy and procedures and those additional that may be established from time to time for the purposes expressly permitted under this agreement.

User Content. By placing "Your Information" which is defined and that you agree to as any materials, information or data in any form that you provide to us in the course of using this website or services including, but not limited to, any public message area or through any email feature you agree to the following: You are solely responsible for your information, and we act as a passive conduit for the online distribution and publication of your information. You hereby grant RentMe-AZ.com’s  and its partners, including, but not limited to, RentMe-AZ.com’s, RentMe Corp. and related entities (collectively, "the Partners") and any other websites to use your information for the purposes described in this agreement. You agree to grant RentMe-AZ.com’s  and its partners, including, but not limited to, RentMe-AZ.com’s, RentMe Corp. and related entities (collectively, "the Partners") or any other entity a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through several tiers) right to exercise and use any intellectual property and publicity rights (but no other rights) you have in your Information, in any media now known or not currently known, with respect to your Information. RentMe-AZ.com will only use your Information in accordance with our Privacy Policy. RentMe-AZ.com may only use your trademarks, service marks and trade names to properly identify buildings, items, or land owned or managed by you.

You also agree to indemnify, defend and hold RentMe-AZ.com and the Partners harmless against any claims or costs, including attorneys' fees, arising from the use or distribution of those materials. You also grant RentMe-AZ.com and the Partners the right to use your name in connection with the reproduction or distribution of such material.

By entering into this Agreement, you hereby represent and warrant that: (a) you will not transmit to RentMe-AZ.com or any Renter any information or materials of any kind which (i) violate, plagiarize or infringe on the intellectual property or contractual rights of any third party; (ii) contain libelous, defamatory, obscene, pornographic, abusive or otherwise unlawful material; or (iii) contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (b) your use of our website and services will at all times comply with all applicable laws, rules, and regulations and that you will do nothing to incur liability for RentMe-AZ.com and it’s partners or cause RentMe-AZ.com and it’s partners to lose (in whole or in part) the services of RentMe-AZ.com' ISP's or other partners or suppliers; (c) you have the power and authority to enter into this Agreement: if you are an individual, this includes, without limitation, that you are of the legal age in your state of residence to make contracts; (d) you are an employee, agent or representative of the properties that you are registering or registering with, and you have the authority to negotiate a Lease Transaction on behalf of the properties; and (e) all information supplied or to be supplied by you relating to this website and RentMe-AZ.com’s services is and will be accurate and complete.

We may amend this Agreement (including, without limitation, the Terms of Use and/or our Privacy Policy, Price and duration of ad’s) at any time by posting the amended terms on the RentMe-AZ.com website. Except as otherwise provided herein, changes to this Agreement are effective thirty (30) days after we provide you with notice of the change by email or post a notice on the website. This Agreement may not be otherwise amended except in a writing signed by both parties.

You and RentMe-AZ.com are independent contractors, and no agency, partnership, joint venture, or employee-employer relationship is intended or created by this Agreement.

Except as explicitly stated otherwise, any notices shall be given by email to info@RentMe-AZ.com (in the case of RentMe-AZ.com) or to the email address you provide to RentMe-AZ.com during the registration process (in your case), or such other address as the party shall specify. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to RentMe-AZ.com during the registration process. In such case, notice shall be deemed given three (3) days after the date of mailing.

Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. Any action related to this site will be governed by the laws of the State of Arizona without regard to its conflict of law provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of our Advertising Policy will be the state and federal courts located in Maricopa County, Arizona, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.

The Service's forums, bulletin boards and chat rooms are provided to give users 18 years of age and older an interesting and stimulating forum in which they can express their opinions and share their ideas. RentMe-AZ.com and their affiliates do not endorse the accuracy or reliability of any advice, opinion, statement or information posted on these forums, message boards, bulletin boards or chat rooms. Please use your best judgment, and be respectful of other individuals using these forums. Do not use vulgar, abusive or hateful language. You may not use the Service's message boards, bulletin boards or chat rooms for advertising or promotional materials or other forms of solicitation. Uploading copyrighted or other proprietary material of any kind on the Service without the express permission of the owner of that material is prohibited and may result in civil and/or criminal liability.

Given the nature of the Service and the volume of messages and postings, RentMe-AZ.com cannot and does not monitor all of the material posted or transmitted by users and third-party information providers. While you agree that the Service will not be liable for such third-party content, RentMe Corp.com reserves the right to delete, move or edit any communications or content that it deems in its sole discretion to be: violative of this Terms of Service; harmful to individuals or communities; obscene; defamatory; in violation of RentMe-AZ.com’s or any third-party's rights; or otherwise unacceptable.

User Content. By placing material on or communicating with RentMe-AZ.com’s web site and the Service, you hereby grant to RentMe-AZ.com’s  and its partners, including, but not limited to, RentMe-AZ.com’s, RentMe Corp. and related entities (collectively, "the Partners") the royalty-free, perpetual, irrevocable, sub-licenseable, nonexclusive right and license to use, copy, modify, display, distribute and reproduce all such materials in any form, media, software or technology of any kind now existing or developed in the future. You also agree to indemnify, defend and hold RentMe-AZ.com and the Partners harmless against any claims or costs, including attorneys' fees, arising from the use or distribution of those materials. You further grant RentMe-AZ.com and the Partners the right to use your name in connection with the reproduction or distribution of such material.

Unsolicited Materials. RentMe-AZ.com does not accept unsolicited materials or ideas for use or publication in its programming or in other digital, electronic or print media except in connection with the forums, chat rooms and bulletin boards on the Service. RentMe-AZ.com and the Partners shall not be responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to the Service.

Prohibited Activities and Content. The following is a partial list of the kinds of activities and content that are prohibited on or through the Service: (a) submitting content that is patently offensive to the online community, such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; (b) engaging in activities or submitting content that could be harmful to minors; (c) engaging activities or submitting content that harass or advocate harassment of another person; (d) engaging in activities that involve the transmission of "junk mail" or unsolicited mass mailing or "spam"; (e) engaging in activities or submitting content that promote information that is false, misleading or promote illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; (f) submitting content that contains restricted or password only access pages, or hidden pages or images; (g) submitting content that displays pornographic or sexually explicit material of any kind; (h) submitting content that provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; (i) engaging in activities or submitting content that solicit passwords or personal identifying information for commercial or unlawful purposes from other users; and (j) engaging in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Access to the Service. You agree that you will not: (a) use any robot, spider, other automatic device, or manual process to monitor or copy web pages or the Content contained in the Service or for any other unauthorized purpose without our prior expressed written permission; (b) use any device, software, or routine to interfere or attempt to interfere with the proper working of the Service and the RentMe-AZ.com web site; and (c) take any action that imposes an unreasonable or disproportionately large load on RentMe-AZ.com’s hardware and software infrastructure.

Copyrights and Copyright Agents. It is the policy of RentMe-AZ.com to respond to claims of intellectual property infringement. RentMe-AZ.com will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) ("DMCA") and other applicable intellectual property laws.

Pursuant to the DMCA, notifications of claimed copyright infringement should be sent to a Service Provider's Designated Agent. Notification must be submitted to the following Designated Agent for these sites:

The Service and materials contained herein are provided on an "as is," "as available" basis, and RentMe-AZ.com and the Partners make no representations or warranties, expressed or implied, to any actual or prospective lessee of any property as to the existence, ownership or condition of the apartment, or as to the accuracy or completeness of any information about the apartment contained in this Service. You acknowledge that your reliance on any such materials shall be at your sole risk. RentMe-AZ.com reserves the right, and its sole discretion, to correct any error or omission in any portion of the Service or materials. Any and all concerns, differences or discrepancies must be addressed with the owner, manager or other third party listing the apartment. You agree to release, hold harmless and indemnify RentMe-AZ.com and the Partners from any and all liability arising from incorrect or incomplete information regarding any rental described in the Service.

Miscellaneous. RentMe-AZ.com reserves the right at its discretion to change these Terms of Service and will notify users of any such changes by online postings. Your continued use of the Service after the posting of any amended Terms of Service shall constitute your agreement to be bound by any such changes. The Service may modify, suspend, discontinue or restrict the use of any portion of the Service, including the availability of any portion of the Content at any time, without notice or liability.

RentMe-AZ.com and the Partners specifically disclaim any implied warranties, including the warranties of merchantability and fitness, for a particular purpose regarding any property with information provided in this Service.

General Disclaimer and Limitation of Liability.  You agree that use of our service is at your own risk. Neither RentMe-Az.com, or any of it’s affiliates, employees, suppliers, agents, partners, content providers make any representation or warranties of any kind regarding the service, content, material or the results that may be obtained from the use of the service. The service is provided on an “AS IS” “WITH ALL FAULTS” and “AS AVAILABLE” basis, and RentMe-AZ.com and the partners disclaim any and all express or implied warranties or conditions, express, statutory and implied, including without limitation of merchantability, fitness for a particular purpose or infringement.

RentMe-AZ.com It’s affiliates, employees, agents, partners, content providers and licensors shall in on event be liable for a any damages or losses including, without limitation, direct, indirect, consequential, special, incidental or punitive damages resulting from or caused by the service or its content, including without limitation, losses related to : your use or inability to use the service, any errors, omissions or defects in the content, or any interruptions, delays in transmission in any event, any liability of RentMe-AZ.com, its affiliates, employees, agents, partners, content providers shall not exceed the amount paid by you to the service in the 6 months prior to the claimed injury or damage.

These Terms of Service will be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflicts of law provisions. You hereby agree that any cause of action you may have with respect to the Service must be filed in the federal or state courts located in Maricopa County, AZ., within one year after the cause of action arises or the cause is barred.
